Bodyfaze takes your privacy very seriously. Please read this Privacy Policy carefully as it contains important information about what to expect when we collect personal information about you and how we will use your personal data.
This policy applies to information we collect about visitors to our website and people who do business with us or enrol for any of our training and services.

1.We gather this information to allow us to process your registration to provide the services requested. Subscriber information is retained in the local database indefinitely for analytic tracking purposes and for future export. Data will be exported or removed upon users request via the existing Exporter or Eraser. If syncing data to a 3rd party service (for example Mailchimp), data is retained there until unsubscribed or deleted.
The relevant information is then used by us, our agents and sub-contractors to provide you with statements of your account and to communicate with you on any matter relating to the conduct of your account and the provision of the goods and services in general provided by Bodyfaze.
2.We may also use aggregate information and statistics for the purposes of monitoring website usage in order to help us to develop our website and our services. We may also provide such aggregate information to third parties. These statistics will not include information that can be used to identify you.
2a.From time to time we may provide your information to our customer service agencies for research and analysis purposes so that we can monitor and improve the good and services that we provide. We or our agents and sub-contractors may contact you by post, email or telephone to ask you for your feedback and comments on our goods and services.
Bodyfaze may release any information that is required by law or court order.

This is so we can recognise and approve any follow-up comments automatically instead of holding them in a moderation queue. For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.  With regard to HMRC and insurance purposes, data is held under their legal restrictions.

Events Manager as a booking system - We use Google services to generate maps and provide auto completion when searching for events by location, which may collect data via your browser in accordance to Google's privacy policy. We collect and store information you submit to us when making a booking, for the purpose of reserving your requested spaces at our event and maintaining a record of attendance. We collect and store information you submit to us about events (and corresponding locations) you would like to publish on our site. We may use cookies to temporarily store information about a booking in progress as well as any error/confirmation messages whilst submitting or managing your events and locations.

18. Subscription forms. If you submit a subscription form on our site you will be opting in for us to save your name, email address and other relevant information. These subscriptions are used to notify you

24. How we protect your data. Our website uses Wordfence firewall for security. Where possible we use a two factor authentication system. All hard copies are kept under lock and key. Only necessary data relevant to us for our services is kept for the duration that we are legally bound or until you no longer require our services.

We use secure third parties where necessary for extra security such as mailchimp - email provider, memberpress - a secure member gateway.

27. Photo Gallery. When you leave a comment on this site, we send your name, email address, IP address and comment text to example.com. Example.com does not retain your personal data.

38. Third Party Add On - Popup Maker. If you submit a subscription form on our site you will be opting in for us to save your name, email address and other relevant information. Popup Maker anonymously tracks popup views and conversions. Subscriber information is retained in the local database indefinitely for analytic tracking purposes and for future export. Data will be exported or removed upon users request via the existing Exporter or Eraser. If syncing data to a 3rd party service (for example Mailchimp), data is retained there until unsubscribed or deleted. Popup Maker does not send any user data outside of your site by default. If you have extended our subscription forms to send data to a 3rd party service such as Mailchimp, user info may be passed to these external services. These services may be located abroad.

BODYFAZE TERMS AND CONDITIONS
Please do not use our website or services if you disagree with any part of these Terms and Conditions.
The following Terms and Conditions have been prepared to help you make the most of Bodyfaze. Please take a few moments to read them thoroughly.
AGREEMENT
1 Interpretation and Variation
1.1 In the Terms and Conditions the following definitions apply:
"Bodyfaze" means Bodyfaze, Bodyfaze Personal Training, Bodyfaze Circuits, Bodyfaze Pilates, Bodyfaze TKO or any other term including the name Bodyfaze.
"Client" means any person that has completed and submitted the Client Questionnaire and PARQ form and has been accepted by Bodyfaze.
“Trainer” means any person who is an instructor of Bodyfaze .
"Terms and Conditions" means these terms and conditions.
"Website" means www.bodyfaze.com.
1.2 References in the Terms and Conditions to the singular will include the plural and vice versa and references to the masculine gender will include references to the feminine gender.
1.3 The Terms and Conditions are incorporated into the health questionnaire and registration forms
1.4 Bodyfaze reserves the right to vary and revoke the Terms and Conditions from time to time which variation it may consider necessary or desirable for the regulation of the affairs of the training and the conduct of Students. Any such changes will be notified to Students and, until revoked, are and will be binding for Students.
1.5 The Terms and Conditions will be governed by the laws of England and subject to the exclusive jurisdiction of the English courts.
2 Booking and Cancellation
2.1 Receipt of payment and signed questionnaire and PARQ forms renders the client liable for payment of their full fees subject to the limitations contained under the cancellation below
2.2 Full fees are payable subject to the limitations contained under the cancellation below and agreed payment terms.
2.3 If cancellation is received 48 hours prior to the booked session then there will be a £0 cancellation charge. No refunds will be given.
2.4 If cancellation is received 24 hours prior to the booked session then there will be a 50% cancellation charge.   No refunds are given.                                                                                                          2.5 If cancellation is received 112 hours or less prior to the booked session then there will be 100% cancellation charge. No refunds are given.3 Fitness and Health
3.1 Clients are advised not to undertake strenuous physical activities without first seeking medical advice if they have concerns over their physical condition. Bodyfaze reserves the right to refuse access to any Client if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of its facilities.
3.2 Clients are required to follow the instructions of the Instructor at all times.
3.3 Clients are required to inform the Instructor, if they incur injuries or conditions, after the initial information stated on their health questionnaire.
4 Safety and Hygiene
4.1 In the interests of safety and hygiene, no crockery or glass are permitted in the Studio. No pets (with the exception of guide dogs), are permitted in the Studio/gym. Clients must not walk around the Studio/gym barefoot if they have verrucas or similar foot complaints. Please wear socks or indoor flip-flops.
4.2 Clients must use the main entrance to the Studio/gym when entering or leaving the Studio/gym. Fire exits, which are clearly marked, are there in the interests of safety and Members must not interfere with these exits for any reason.
4.3 In the event of a fire, Clients are asked to make their way to the nearest available exit.
4.4 Smoking is forbidden in the Studio/gym.
5 Personal Belongings
5.1 Personal belongings are brought onto the Studio/gym premises at the Client’s own risk and Bodyfaze does not accept liability for any loss or damage whatsoever to such items.
5.2 Vehicles parked in the Studio/gym car park are parked at the Clients’s own risk and Bodyfaze accepts no liability for any loss or damage whatsoever to such vehicle.
6 Limitation of Liability
6.1 Places are subject to availability. Bodyfaze reserves the right to cancel, withdraw, change or relocate a class/session within a reasonable time frame. Bodyfaze shall not be held liable for any loss of earnings or expenses as a result of such changes.
6.2 Travel, accommodation and loss of earnings resulting from the attendance of Bodyfaze are the full responsibility of the Client. Bodyfaze under no circumstances accept any liability for these costs.
6.3 Bodyfaze cannot be held responsible for cancellations caused by circumstances outside of their control. (i.e., weather, travel issues, strikes etc) Bodyfaze will make reasonable attempts to respond to such situations and achieve a satisfactory resolution.
6.4 It is the Client's responsibility to ensure that he is capable of undergoing a routine of exercises provided by any programme which he follows or session which he attends. Client’s accept the risk of injury from performing exercises and using specialist equipment and are advised to consult their doctor prior to beginning any session. Advice provided by Instructors at Bodyfaze at no time constitutes medical advice in substitute for advice provided by a medical professional
6.5 Bodyfaze accepts no liability for loss or damage to property of Client’s or for injury to Client’s on the Studio/gym premises or outside the Studio/gym except insofar as such loss, damage or injury is by law incapable of exclusion.
6.6 In consideration of their participation in the activities and programmes of Bodyfaze and the use of facilities and equipment owned and/or under the control of Bodyfaze the Client hereby waives and releases Bodyfaze and it’s Instructors from any and all responsibility or liability for injuries or damages resulting from their participation in any of the Bodyfaze’s activities or use of Bodyfaze’s equipment or facilities save in respect of death or personal injury caused by the negligent act or omission of Bodyfaze.
7 General
7.1 Bodyfaze do not allow use of materials provided for any purpose other than the study of the student. Any duplication of all or part of the supplied materials is in direct breach of copyright laws and will result in legal proceedings including full reimbursement of all legal costs incurred
7.2.Bodyfaze keeps contact form submissions for a certain period for customer service purposes, but you do not use the information submitted through them for marketing purposes.

7.6 Client’s are required to give notice to Bodyfaze of any change of home address or email address. Failing such notice, all communications will be assumed to have been received by the Client within five days of mailing to the last address (of either type) notified to Bodyfaze
7.7 Bodyfaze may, if a Client so wishes, communicate with the Client by electronic mail ("email"). By providing an email address to Bodyfaze, the Client consents to receiving email communications from Bodyfaze, including notices pursuant to the Terms and Conditions. The Client also accepts the risk that email may not be a secure and confidential means of communication. Bodyfaze will not be liable for any loss or damage suffered as a result of communicating with a Client by email.
